Terms of Use

These Terms of Use ("Terms") govern your use of writivate.com (the "Site") and the courses, programs, content, and services Writivate, LLC ("Writivate," "we," "us," or "our") offers through it. By using the Site or our services, you agree to these Terms. If you don't agree, please don't use the Site.

1. Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, to create an account or make a purchase. If you're younger, you may use the Site only with the involvement of a parent or guardian. You're responsible for keeping your login credentials confidential and for activity under your account. Accounts are for one person and may not be shared.

2. Courses, programs, and purchases

Prices, payment terms, program requirements, and any refund or cancellation terms are described on the relevant offer, checkout, or enrollment page, and those terms apply to your purchase. Some programs have additional participation or completion requirements, which we'll share before you enroll. We may update, reschedule, or discontinue courses and programs, and we'll make reasonable efforts to notify affected participants.

3. No guarantee of outcomes

Our courses and programs are designed to build knowledge and skills. Completing them does not guarantee employment, admission to an apprenticeship or other program, a certification or credential from any third party, or any specific career or financial result. Your results depend on many factors outside our control.

4. Educational purposes only

Content on the Site and in our programs is provided for educational purposes. It is not legal, medical, regulatory, or other professional advice, and it should not be relied on as a substitute for advice from a qualified professional or for your employer's policies and procedures.

5. Intellectual property

The Site and our course and program materials, including text, videos, graphics, curricula, and downloads, are owned by Writivate or our licensors and are protected by copyright and other laws. When you enroll, we grant you a limited, personal, non-transferable, non-exclusive license to access the materials for your own learning. You may not copy, record, redistribute, resell, publicly share, or create derivative works from our materials without our written permission.

6. Your content and community conduct

If you post or submit content, such as assignments, comments, or community posts, you keep ownership of it and grant us a non-exclusive license to host and display it as needed to operate our programs. When using our Site or community spaces, you agree not to:

  • harass, threaten, or discriminate against others;
  • post content that is unlawful, misleading, or infringes someone else's rights;
  • share confidential or proprietary information belonging to an employer, client, or anyone else;
  • attempt to disrupt, hack, or misuse the Site; or
  • use the Site to send spam or unsolicited promotions.

We may remove content or suspend access for conduct that violates these Terms.

7. Use of AI tools in our programs

Some activities may involve AI tools. You're responsible for reviewing and verifying any AI-generated output you use, and you must not enter confidential, proprietary, or protected information into AI tools unless you're authorized to do so. Learn about our approach to responsible AI.

8. Third-party services and links

The Site runs on third-party platforms, including Kajabi, and payments are processed by third-party payment processors. The Site may also link to websites we don't control. We're not responsible for third-party services or content, which are governed by their own terms and policies.

9. Privacy

Our Privacy Policy explains how we collect and use personal information.

10. Disclaimers

The Site and our services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Site will be uninterrupted, error-free, or free of harmful components.

11. Limitation of liability

To the fullest extent permitted by law, Writivate will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities, arising from your use of the Site or our services. Our total liability for any claim relating to the Site or our services will not exceed the amount you paid us for the service giving rise to the claim in the 12 months before the claim arose.

12. Indemnification

You agree to indemnify and hold harmless Writivate and its owners, employees, and contractors from claims, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or misuse of the Site.

13. Suspension and termination

We may suspend or end your access to the Site or our services if you violate these Terms or if we reasonably need to protect our users, programs, or business. Sections that by their nature should survive termination will survive.

14. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. You agree that any dispute will be brought in the state or federal courts located in Massachusetts.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we'll post the revised version on this page and update the effective date. Continuing to use the Site after changes take effect means you accept the updated Terms.
